Notification of Copyright Violations

We act only as a passive conduit for online distribution and publication of information. We cannot and do not censor, control, monitor or referee any content or communication that is accessible through a DSL.net service or over the DSL.net network and/or hosting servers (the "DSL.net Servers"). It is our policy, however, to respect the intellectual property rights of third parties and to respond appropriately when DSL.net becomes aware that materials that violate another's copyright or intellectual property rights may be hosted on and accessible through the DSL.net Servers.

Any person (a "Complaining Party") with a good faith belief that use of certain materials hosted on the DSL.net Servers is not authorized by the copyright owner, its agent, or the law, may request removal of, or limitation of access to, such materials hosted on the DSL.net Servers by sending to DSL.net's Designated Agent (as set forth below) a written notice, signed by a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed, containing substantially the following:

  • Identification of the copyrighted work claimed to have been infringed, or if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site;
  • Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled (individually or collectively the "Identified Materials"), and information reasonably sufficient to permit DSL.net to locate the Identified Materials;
  • Information reasonably sufficient to permit DSL.net to contact the Complaining Party, such as an address, telephone number, and, if available, electronic mail address at which the Complaining Party can be contacted;
  • A statement that the Complaining Party has a good faith belief that use of the Identified Materials in the manner complained of is not authorized by the copyright owner, its agent or the law; and
  • A statement that the information in the notification is accurate, and under penalty of perjury, that the Complaining Party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Without limiting the forgoing, any such written notice must comply with all of the notice requirements of the Digital Millennium Copyright Act, 17 U.S.C. 512, et. seq. ("DCMA"), as amended from time to time.

In the event that DSL.net receives notification as set forth above, DSL.net will comply with the provisions of the DCMA and take such steps that it believes to be appropriate under the circumstances.
